# Terms of Service for ShotSpot

Welcome to ShotSpot. These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and ShotSpot ("we," "our," or "us"). These Terms govern your access to and use of the ShotSpot mobile application, software, and related services (collectively, the "Service").
By creating an account, accessing, or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.

### 1. Eligibility and Accounts
*Age Requirement:** You must be at least 13 years old to access or use the Service.

### 2. Physical Location Safety, Property Access, and Scouting Disclaimers
ShotSpot provides tools for organizing and discovering potential photography locations. By using the Service, you expressly understand and agree to the following:
*Lawful Access and No Trespassing:** You are strictly prohibited from using the Service to facilitate trespassing or unauthorized access to private property. You are solely responsible for verifying the legal status of any location, obtaining required commercial photography permits, and securing explicit property owner permission before entering any site.
*Environmental and Physical Hazards:** Location conditions, terrain stability, tidal levels, sun patterns, weather hazards, and physical safety risks are variable and unpredictable. You assume all responsibility and risk for your physical safety and gear when scouting, traveling to, or shooting at locations recorded in or discovered through the Service.
*No Warranty on Location Viability:** We do not guarantee that any coordinate, public access route, lighting condition, or location description stored in the Service is accurate, legal, safe, or currently open to the public.

### 3. User Content and Intellectual Property
*Your Content:** You retain full ownership and copyright of any photos, notes, coordinates, spot descriptions, or metadata that you upload or record within the Service ("User Content").
*License to Operate:** By submitting User Content to the Service, you grant ShotSpot a worldwide, non-exclusive, royalty-free license to host, store, process, display, and reproduce your content solely to the extent necessary to operate, maintain, and provide the features of the Service to you.
*Content Standards:** You agree not to upload content that infringes upon the intellectual property, privacy, or publicity rights of any third party, or that contains malicious code, viruses, or defamatory material.

You agree not to engage in any of the following prohibited actions:
* Reverse engineering, decompiling, disassembling, or extracting the source code of the Service.
* Circumventing, disabling, or interfering with security-related features of the platform or our backend infrastructure.
* Scraping, crawling, data mining, or harvesting location coordinates or system data using automated scripts or tools.
* Using the Service for any unlawful, harassing, fraudulent, or malicious purpose.

WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, ACCURATE, OR ERROR-FREE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL SHOTSPOT, ITS OWNERS, AFFILIATES, OFFICERS, OR SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, PUNITIVE, OR EXEMPLARY DAMAGES. THIS INCLUDES DAMAGES FOR PERSONAL INJURY, PROPERTY DAMAGE, TRESPASSING FINES OR LEGAL LIABILITIES, LOSS OF GEAR OR PROFITS, DATA LOSS, OR SERVICE INTERRUPTIONS ARISING OUT OF OR IN CONNECTION WITH YOUR ACCESS TO OR INABILITY TO USE THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL AGGREGATE LIABILITY ARISING FROM OR RELATING TO THE SERVICE SHALL NOT EXCEED THE GREATER OF FIFTY US DOLLARS ($50.00) OR THE TOTAL AMOUNT PAID BY YOU TO SHOTSPOT IN THE PAST TWELVE MONTHS.
